Draft revision of the Catalogue of Technologies Prohibited or Restricted from Export (AI, biomedicine and photovoltaic additions) and interim pre-export registration (MOFCOM and MOST Announcement No. 48 of 2026)
Consultation draft adding 40 technologies to China’s export catalogue: 23 AI technologies (large models, agents, computing clusters, information processing), 5 biomedicine and 12 photovoltaic. 14 would be prohibited from export (including AI-driven malicious code generation and mutation) and 26 restricted (including AI-assisted vulnerability discovery), with automatic licensing for open-sourcing, companies’ own overseas computing centres, overseas chip tape-out, joint R&D and standards work; technology already in the public domain through open source or papers is excluded. From 16 Oct 2026 until the revised catalogue takes effect, exporters must register transfers of the listed technologies in advance on MOFCOM’s technology trade platform (ownership transfers, licensing abroad, change of owner or controller to a foreign entity).
Why it matters
Transferring restricted model technology out of China needs registration now and a licence later; serving a model abroad through an API, an app or SaaS does not count as a technology export, according to the ministry.
