ICO issues Snap a preliminary enforcement notice over its My AI chatbot

See how this story connects

The Information Commissioner’s Office issued Snap a preliminary enforcement notice on 6 October 2023, provisionally finding that Snap had not properly assessed the privacy risks of My AI, its GPT-based chatbot in Snapchat, before launch, particularly for users aged 13 to 17. My AI reached UK Snapchat+ subscribers in February 2023 and the wider UK user base in April 2023. A final notice could have required Snap to stop processing data for My AI in the UK until it completed an adequate risk assessment.

Why it matters

Companies adding generative AI chatbots to consumer apps were put on notice that the UK data regulator expects a full data protection risk assessment, covering children, before launch.
