SEC proposes conflict rules for brokers and advisers using predictive data analytics

See how this story connects

The SEC proposed rules on 26 July 2023 that would require broker-dealers and investment advisers to assess whether their use of predictive data analytics and similar technology with investors puts the firm’s interests first, and to eliminate or neutralise any such conflict. Firms would need written policies and records. Chair Gary Gensler had told the National Press Club on 17 July that AI could encourage herding and that he had asked staff for proposals on these conflicts. The SEC withdrew the proposal in June 2025.

Why it matters

US brokers and advisers using AI in apps, nudges and recommendations faced a proposed duty, later withdrawn, to find and remove conflicts in those tools.
