Pennsylvania enacts law requiring AI labels on misleading ads

See how this story connects

Governor Josh Shapiro signed SB 806, the Artificial Intelligence Deceptive Advertising Act (Act 99 of 2026), on 22 October. Advertisers may not knowingly, recklessly or willfully spread an ad that uses AI-generated or significantly AI-modified content in a way that creates a false impression of a product’s nature, origin or authenticity without a clear and conspicuous label saying the ad contains AI-made content. The label must appear when the content is first shown, in the same medium and, where technically feasible, be hard to remove; content that is evidently fictional, parody, satire, commentary or text only is exempt.

Why it matters

From 60 days after signing, the Attorney General and district attorneys can seek injunctions against unlabelled AI ads in Pennsylvania, and courts can impose fines of up to $3,000 plus legal costs.
