OMB memo M-24-18 sets AI buying rules for US agencies, including no training on their data

See how this story connects

OMB memorandum M-24-18, dated 24 September 2024, sets requirements for federal agencies buying AI systems and services. Contracts for rights- or safety-impacting AI had to comply by 1 December 2024, and other AI contracts apply from solicitations issued 180 days after the memo. Contracts must define government data and model rights, should bar vendors from training public or commercial models on agency inputs and outputs, should require incident reports generally within 72 hours, and should include terms against vendor lock-in such as data portability and no cloud egress fees.

Why it matters

AI vendors selling to US agencies faced contract terms on testing, incident reporting, data use and portability, applied by agencies’ contracting officers.
