Senate declines to take up repeal of Medicare’s AI prior-authorisation pilot

See how this story connects

The Senate voted 46 to 50 on 16 July 2026 against a motion to proceed to S.J.Res. 198, a Congressional Review Act resolution led by Senator Ron Wyden to repeal CMS’s WISeR model, the AI-assisted prior-authorisation pilot that began on 1 January 2026 in Arizona, New Jersey, Ohio, Oklahoma, Texas and Washington and runs to the end of 2031. The vote split along party lines. The route to a vote opened in May, when the Government Accountability Office found the model is a rule under the Act. CMS has said clinicians, not algorithms, have the final say on denials.

Why it matters

WISeR continues in all six states, and the only way left to stop it in Congress is through spending bills.
