Italy’s data protection authority fines OpenAI €15m over ChatGPT

See how this story connects

Italy’s Garante closed its ChatGPT investigation with a €15 million fine on OpenAI and ordered a six-month information campaign on radio, TV, newspapers and the internet about how ChatGPT collects personal data for training. It found an unreported March 2023 data breach, training on personal data without an adequate legal basis, transparency failures and no age verification for children under 13. On 18 March 2026 the Court of Rome upheld OpenAI’s appeal against the decision (judgment 4153/2026), and the Garante took the decision off its website.

Why it matters

OpenAI was ordered to run the first public information campaign under Article 166(7) of Italy’s Privacy Code, but the Court of Rome overturned the decision in March 2026.
