Italy’s data protection authority orders OpenAI to stop processing Italian users’ data
See how this story connectsItaly’s Garante per la protezione dei dati personali ordered OpenAI on 30 March 2023, announced on 31 March, to stop processing Italian users’ personal data with immediate effect, and opened an inquiry into ChatGPT. It cited no legal basis for mass collection of personal data to train the models, no information notice to users, inaccurate outputs about people and no age check for users under 13. OpenAI restored access in Italy on 28 April after adding a privacy notice, an opt-out from training for Europeans and age confirmation at sign-up.
Why it matters
Every developer offering a chatbot in the EU learned that GDPR regulators could halt a service over training data and age checks, and OpenAI changed its privacy controls across Europe in response.
