Utah sets disclosure, advertising and data rules for mental health chatbots

See how this story connects

Governor Spencer Cox signed HB 452 on 25 March 2025. Suppliers of mental health chatbots must disclose that users are talking to AI before first use, after seven days without use and whenever asked; may not sell or share users’ health information or input; and may not use what users say to target ads. Suppliers that keep specified documentation and file a written safety policy with the Division of Consumer Protection gain an affirmative defence against unlicensed-practice or unprofessional-conduct allegations, and violations carry fines of up to $2,500 each.

Why it matters

Companies offering AI mental health chatbots in Utah must keep user health data private and label ads, with a safe harbour for those documenting their safety work.
