US Copyright Office requires applicants to disclose and disclaim AI-generated material

See how this story connects

Guidance published in the Federal Register on 16 March 2023 and effective that day says the Office registers only human authorship and that a prompt alone generally does not make the user an author. Applicants must disclose AI-generated content that is more than de minimis, describe the human contribution and should not list an AI tool as an author. Applicants with pending applications or existing registrations should correct them.

Why it matters

Anyone registering a work made partly with AI in the US must now disclose it, and registrations that omit it risk cancellation or being disregarded in court.
