CFPB, FTC, EEOC and DOJ say existing laws apply to automated systems and AI

See how this story connects

On 25 April 2023 the CFPB, the FTC, the EEOC and the Justice Department’s Civil Rights Division issued a joint statement pledging to enforce existing civil rights, consumer protection, competition and employment laws against discrimination in automated systems, including tools sold as AI. The CFPB listed its earlier positions that opaque credit models do not excuse adverse-action failures under the Equal Credit Opportunity Act and that abusive-practices rules cover misuse of AI.

Why it matters

Lenders and fintech firms using algorithmic credit, marketing or valuation models were told by four federal agencies that no AI-specific exemption exists under the laws they already enforce.
