California signs three election deepfake laws, and a court blocks one within weeks

See how this story connects

Governor Gavin Newsom signed three bills on 17 September 2024: AB 2655 requires large online platforms to remove or label deceptive AI-altered content about candidates and officials before elections, AB 2839 lets candidates and officials sue over materially deceptive election deepfakes and took effect at once as an urgency measure, and AB 2355 requires disclosure on political ads using AI-generated or altered content. On 2 October 2024 the US District Court for the Eastern District of California issued a preliminary injunction blocking enforcement of AB 2839 in Kohls v. Bonta.

Why it matters

Platforms and political advertisers in California took on deepfake removal, labelling and disclosure duties, while the injunction showed state election deepfake laws can fail free-speech challenges.
