EDPB opinion sets GDPR tests for training and deploying AI models
See how this story connectsThe European Data Protection Board adopted an opinion on 18 December 2024, requested by Ireland’s Data Protection Commission, on personal data in AI models. It says data protection authorities should judge case by case whether a model is anonymous, sets a three-step test for relying on legitimate interest, and covers the consequences when a model was built with unlawfully processed personal data.
Why it matters
AI developers using personal data of people in the EU got the regulators’ shared test for anonymity and legitimate interest, which national authorities apply in GDPR cases against model makers.
