Commission moves to withdraw the proposed AI Liability Directive

See how this story connects

The Commission’s 2025 work programme, adopted on 11 February 2025, listed the AI Liability Directive proposed in September 2022 among 37 proposals it intended to withdraw, citing no foreseeable agreement. The withdrawal was confirmed in an Official Journal notice on 6 October 2025, and the Commission said it would assess whether to table a new proposal or another approach.

Why it matters

People harmed by AI systems in the EU are left with national fault rules and the revised Product Liability Directive, with no EU-wide rules easing proof in fault-based AI claims.
