Brazil’s electoral court bans deepfakes and requires AI labels in campaign material

See how this story connects

Brazil’s Superior Electoral Court (TSE) approved Resolution 23.732 on 27 February 2024, amending its election propaganda rules for the October 2024 municipal elections. Campaign content made or altered with AI must carry an explicit, prominent label, chatbots and avatars may not simulate conversation with a candidate or other real person, and deepfakes that harm or favour a candidacy are banned, with breaches punishable by cancellation of a candidate’s registration or mandate. Platforms must act against notoriously false electoral content without waiting for a court order and become jointly liable if they fail to remove listed content during the election period.

Why it matters

Candidates in Brazil’s 2024 municipal elections risked losing their registration or office for deepfakes, and platforms took on removal duties and liability without needing a court order.
