UK High Court rejects Getty's secondary copyright claim against Stability AI

In [2025] EWHC 2863 (Ch), Mrs Justice Joanna Smith held that Stable Diffusion's model weights do not store Getty's photographs and so are not an 'infringing copy' that could be imported or dealt with in the UK. Getty had dropped its primary claim over training, which took place outside the UK; the court found only limited trade mark infringement in older model versions that reproduced Getty watermarks.

Why it matters

The first major UK ruling on generative AI and copyright leaves training-location questions open but makes it hard to sue over a model itself being made available in Britain.
